PRIVACY POLICY – Ink.Inc

This Privacy Policy explains what information Ink.Inc Tattoos Ltd collects about you and why, what we do with that information, how we share it, and how we handle the content you provide to us while using our products and services.

THE SCOPE OF PRIVACY POLICY INTRODUCTION

This Privacy Policy applies to information we collect from you when you use our services, via a “Device,” or otherwise interact with Ink.Inc. You consent to the collection, transfer, processing, storage, disclosure, and other uses described in this Privacy Policy by using our services.

DEFINITIONS

The following definitions will apply to terms used in this Privacy Policy:

When interacting with Ink.Inc, content refers to any information or data that you upload, submit, post, create, transmit, store, or display. A Device is any computer that is used to access our services, such as a desktop, laptop, mobile phone, tablet, or other consumer electronic device.

The term “information” refers to all the various types of data, content, and information collected by us as described in this Privacy Policy. Our services include the provision of a website(s).

Personal information is defined as any information that can be used to easily identify or contact you as an individual person, such as your name, address, email address, or phone number. Personal information does not include information that has been anonymised in such a way that it cannot be easily identified as belonging to a specific individual. Websites refers to any of Ink.Inc’s websites, including but not limited to Ink.Inc and any associated websites, sub-domains, and pages.

IMPROVEMENTS TO OUR PRIVACY POLICY

We reserve the right to modify this Privacy Statement at any time. If we make any changes, we will notify you by updating the “Last Updated” date at the top of this Privacy Policy, and in some cases, we may provide you with additional notice (such as adding a statement to our website or sending you an email notification). We encourage you to review our Privacy Policy whenever you use our services so that you are aware of our information practices and how you can help protect your privacy. If you do not agree with any changes to this Privacy Policy, you must discontinue using our services.

INFORMATION COLLECTION INFORMATION YOU PROVIDE TO US

We collect the following information from you:

Account Information: When you register for an account with us, make a purchase, or otherwise use, access, or interact with our services, we collect information about you and

your company. We may collect information such as your name, address, email address, phone number, job title, or credit card information. When you place an order for our services, you may provide this information directly, or another person may do so on your behalf in some cases (most commonly when an intermediary facilitates your use of our products). If you provide information (including Personal Information) about another person, you confirm that you have the authority to act on their behalf and that you consent to the collection and use of their Personal Information as described in this Privacy Policy.

We collect and store Content that you create, enter, submit, post, upload, transmit, store, or display while using our services, ordering our products, or accessing our websites. Any Personal Information or other sensitive information that you choose to include (“passively- collected Personal Information”) is included in such Content.

Other: We collect other data that you submit to our websites or as you use any of our services, participate in a survey, contest, promotion, sweepstakes, activity, or event, apply for a job, request customer support, communicate with us through third-party social media sites, or otherwise communicate with us. For example, information about a problem you’re having with an Ink.Inc product could be submitted to our Support Services or posted in any public forums, and any information you submit to our websites, including Personal Information, could be visible to the public unless submitted to a secure area of the Website.

WE COLLECT INFORMATION FROM YOUR USE OF OUR SERVICES

While using our services, we may collect the following information:

Logs on the internet: When you interact with our websites, we collect certain information and store it in log files, just like most websites. This information includes internet protocol (IP) addresses, browser type, internet service provider, URLs of referring/exit pages, operating system, date/time stamp, search terms, locale and language preferences, identification numbers associated with your Devices, your mobile carrier, and system configuration information.

Data from Analytics: When you use our websites, we and our analytics provider collect and store analytics information to help us improve our products and services.

Content-Derived Information: Analytics data also includes information gathered as a result of running queries against Content across our user base in order to generate Usage Data. “Usage Data” is non-personally identifiable data about a group or category of services, features, or users. While compiling Usage Data from Content across user instances, we may come across sensitive or Personal Information as a by-product of our efforts to understand broader patterns and trends. We make no concerted effort to examine the Content of any specific customer.

Cookies and Other Tracking Technologies: What Are They?

We may collect information using a variety of technologies, including cookies stored on your computer or mobile device. Cookies are small data files that are stored on your hard drive or in the memory of your device. We use cookies to improve and personalize our services and your experience; to allow you to access and use the Websites; and to count visits and determine which areas and features of the Websites are most popular.

You can instruct your browser to stop accepting cookies or to prompt you before accepting a cookie from a website you visit by changing its settings. However, if you do not accept cookies, you may be unable to use all aspects of our websites. We may also use web beacons (also known as “tracking pixels”) to collect information. Web beacons are electronic images that may be used in our Websites or emails to assist us in delivering cookies, counting visits, understanding usage and campaign effectiveness, and determining whether an email has been opened and acted upon.

INFORMATION OBTAINED FROM OTHER SOURCES

We may also obtain information from third parties and combine it with data gathered through our services. We may, for example, have access to information from a third-party credit reporting agency. Any access to such information that we may obtain from a third party will be handled in accordance with the procedures established by that service and this Privacy Policy.

By allowing us to connect with a third-party service, you authorize us to access and store your name, email address(es), current city, and any other information made available to us by the third-party service, and to use and disclose it in accordance with this Privacy Policy. You should review your privacy settings on these third-party services to understand and change the information sent to us via these services.

IMPORTANT INFORMATION

The Privacy Act defines sensitive information as information or opinion about an individual’s racial or ethnic origin, political opinions, membership in a political organization, religious or philosophical beliefs, membership in a trade union or other professional body, criminal record, or health information.

We have no plans to collect Sensitive Information from you. If we obtain such information, we will only use it for the primary purpose for which it was obtained, for a secondary purpose that is directly related to the primary purpose with your consent, or where required or authorized by law.

HOW DO WE APPLY INFORMATION? WE COLLECT GENERAL APPLICATIONS

We use the information we collect about you (including Personal Information to the extent applicable) for a variety of purposes, including: providing, operating, maintaining, improving, and promoting our services; enabling you to access and use our services (e.g., facilitating and streamlining orders, taking advantage of limited time promotions); processing and completing transactions, and sending you related information, such as purchase confirmations and invoices; and communicating with you. In general, you can opt out of receiving promotional communications as described below under “Your Choices”; process and deliver contest or sweepstakes entries and rewards; monitor and analyse trends, usage, and activities in connection with our services and for marketing or advertising purposes; investigate and prevent fraudulent transactions, unauthorized access, and other illegal activities; personalize our services, including by providing content.

DISCLOSURE AND SHARING OF INFORMATION

Except as described in this policy, we will not share or disclose any of your Personal Information with third parties. We never sell any of your Personal Information or Content. We may share or disclose your Personal Information in the following circumstances:
Studios: We may be required to share your Personal Information with our tattoo studios.

System Administration: Please be aware that our system administrator may have access to information about you and your account.

Service Providers: We collaborate with third-party service providers to provide and deliver our services, process payments, perform analysis, and provide other services on our behalf. As part of providing those services for us, these third parties may have access to or process your Information.

Laws: We may disclose your Information (including your Personal Information) to a third party if we believe that disclosure is reasonably necessary to comply with any applicable law, regulation, legal process, or governmental request; to enforce our agreements, policies, and terms of service; to protect the security or integrity of Ink.Inc’s products and services; to protect Ink.Inc, our customers, or the public from harm or illegal activities; or to respond to a law enforcement investigation.

Business Transfers: We may share or transfer your information (including Personal Information) in connection with or during negotiations for any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.

Anonymised Data: We may also share aggregated or anonymised information that does not directly identify you with the aforementioned third parties.

Marketing: We may share your Personal Information with our marketing service providers in order to market to you our products and services (including direct marketing).

With Your Consent: We will share your personal information with third parties only if you give us permission to do so.

WE DO NOT SHARE INFORMATION

Without your permission, we will not share Personal Information about you with third
parties for marketing purposes (including direct marketing).

SECURITY, TRANSFER, AND DATA STORAGE

Ink.Inc hosts data with hosting service providers from all over the world. We will make reasonable efforts to keep the servers on which Personal Information is stored in a secure environment. While we make reasonable efforts to protect your Personal Information, no security system is impenetrable, and due to the inherent nature of the Internet as an open global communications vehicle, we cannot guarantee that information will be safe from intrusion by others, such as hackers, during transmission through the Internet or while stored on our systems or otherwise in our care. Furthermore, we cannot guarantee that any passively collected Personal Information you choose to store in Websites is protected at levels sufficient to meet any specific needs or obligations you may have in relation to that information.

We will take reasonable steps to destroy or permanently de-identify your Personal Information when it is no longer required for the purpose for which it was obtained. However, most of the Personal Information is or will be stored in client files, which we will keep for a minimum of 7 years.

YOUR OPTIONS

You can opt out of receiving promotional communications from Ink.Inc by sending us an email requesting that your contact information be removed from our promotional email list or registration database. Although opt-out requests are usually handled immediately, please allow fifteen (15) business days for a removal request to be handled. Even if you opt out of receiving promotional messages from us, you will still receive transactional messages about our services.

ACCESSING AND UPDATEING YOUR DATA

Subject to certain exceptions, you have the right to access the Personal Information we have on file for you and to update and/or correct it. Please contact us in writing if you want to access your Personal Information.

INTERNATIONAL CLIENTS

If you are visiting from the European Union or another region where data collection and use is governed by laws, please be aware that you are agreeing to the transfer of your Personal Information to us in Thailand/Australia. You consent to any transfer and processing of your Personal Information in accordance with this Policy by providing it.
